By using our website or placing an order, you agree to these Terms of Service.
1. About us
In these Terms of Service, we, us, and our mean MB Damn good audio, trading as Damn good audio.
These Terms of Service apply to both consumers and business customers. If you are a consumer, nothing in these Terms of Service limits any mandatory rights available to you under applicable consumer law. If you are purchasing in the course of business, certain consumer protections may not apply to you.
2. Products and orders
We sell products through our Shopify store. Product descriptions, images, specifications, availability, and pricing are presented as accurately as reasonably possible. However, minor differences may occur, including differences in color display depending on your device or screen settings.
Placing an order is an offer to purchase. An order is accepted when we send an order confirmation or otherwise confirm acceptance.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:
- obvious pricing or listing errors
- suspected fraud or abuse
- payment problems
- sanctions or legal restrictions
- unexpected unavailability
- suspected reseller or distributor activity contrary to these Terms of Service
If we cancel an order after payment has been taken, we will refund the amount paid without undue delay.
3. Preorders
Some or all products offered on our website may be sold on a preorder basis. Where a product is marked as a preorder, the item is not ready for immediate dispatch at the time of purchase.
For preorder products:
- the full preorder amount is charged when the order is placed
- preorders may be released in batches
- Batch I will be available until sold out
- Batch II will be available after Batch I sells out
- customers cannot change batch after the order is placed unless we agree otherwise in writing
Preorders for the current release open on June 23, 2026. The first dispatch window is currently estimated for the end of September 2026.
All preorder dates are estimates only. Dispatch timing may be affected by manufacturing constraints, testing, parts availability, customs procedures, freight conditions, or carrier delays. If dispatch is materially delayed, customers may cancel their preorder for a full refund.
4. Prices and payment
All prices are shown in the currency displayed on the website or at checkout. We are not currently VAT registered, so VAT is not charged on our prices.
Shipping costs, and where applicable any other clearly disclosed charges, are shown at checkout before you complete your purchase.
For orders shipped outside the European Union, import duties, local taxes, and customs charges are not included unless expressly stated otherwise and may be charged by the destination country.
5. Shipping and delivery
We ship to the countries made available at checkout. Delivery and dispatch estimates are provided for convenience only and are not guarantees unless expressly stated otherwise.
We provide tracking information for shipped orders where available.
If a parcel is confirmed lost in transit, we will provide a full refund.
6. Returns, withdrawal, and consumer rights
Consumers in the EU / EEA
If you are a consumer in the EU or EEA, you generally have the right to withdraw from your purchase within 14 days after you, or a person you nominate, receives the goods.
For preorder goods delivered months after purchase, this 14-day withdrawal period starts when the goods are actually received, not when the preorder is placed.
If you wish to exercise your withdrawal right, you must notify us within that period using our contact form . You must then return the goods within the period required by applicable law.
For non-defective returns under the withdrawal right, the customer is responsible for the direct cost of returning the goods unless applicable law requires otherwise. We will provide the return instructions and return address after contact.
We will reimburse the amount due in accordance with applicable law. We may withhold reimbursement until we receive the returned goods or proof of return, where permitted by law.
Defective, damaged, or incorrect goods
If goods are defective, damaged, incorrectly supplied, or otherwise not in conformity with the contract, your statutory rights apply. We cover reasonable return shipping costs for such items.
Although we do not offer routine exchanges for convenience, this does not limit any legal remedies available under applicable law, which may include repair, replacement, price reduction, or refund depending on the circumstances.
7. Return condition
For consumer withdrawal returns, goods should be returned in a condition consistent with handling only to the extent necessary to establish their nature, characteristics, and functioning. Original packaging is preferred where available, but not strictly required to exercise mandatory legal rights.
We may reduce a refund where permitted by law if the value of the goods has been diminished by handling beyond what is necessary for inspection.
8. Business customers
If you purchase from us in the course of business, you are responsible for ensuring that the goods are suitable for your intended use. Any consumer-specific withdrawal rights described in these Terms of Service may not apply to you unless mandatory law provides otherwise.
9. Website use and intellectual property
All content on this website, including text, graphics, branding, logos, product images, design elements, and other materials, is owned by us or used with permission and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, scrape, republish, or commercially exploit website content without our prior written permission, except where permitted by law.
10. Liability
Nothing in these Terms of Service excludes or limits liability where such exclusion or limitation would be unlawful, including liability for fraud, death or personal injury caused by negligence, or any mandatory consumer rights.
Subject to the paragraph above, we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss of data arising from your use of the website or purchase of goods, except where such limitation is not permitted by law.
11. Changes to these Terms of Service
We may update these Terms of Service from time to time to reflect changes in our business, products, website, or legal obligations. The version in force at the time of your order will apply to that order unless applicable law requires otherwise.
12. Governing law
These Terms of Service are governed by the laws of Lithuania, except that if you are a consumer, you continue to benefit from any mandatory provisions of the law of your country of residence that cannot be derogated from by contract.
